In Scotland, SDLT does not apply. Instead, buyers pay Land and Buildings Transaction Tax (LBTT). If you are buying a property in Ayrshire while still owning your English home, the purchase is likely to be classed as an additional dwelling and subject to the Additional Dwelling Supplement (ADS). ADS is currently charged at 8% of the full purchase price, on top of standard LBTT, unless specific relief applies.

It’s also worth noting that local authorities across South Ayrshire, East Ayrshire and North Ayrshire have the power to apply increased Council Tax premiums on second homes, often up to double the standard rate.

Buying Before Selling: What Happens?

Many buyers moving from England to Ayrshire consider purchasing first to secure the right property, particularly in competitive local markets. However, buying before selling can have financial implications.

If you complete on an Ayrshire property while still owning your English home, the Scottish purchase is usually treated as a second home for tax purposes. This typically triggers the Additional Dwelling Supplement, even if you plan to sell your English property shortly afterwards.

Relief may be available, but timing is critical. In Scotland, ADS can often be reclaimed if the property you’re buying becomes your new main residence and your previous main home is sold within a set period, commonly 18 months, though circumstances can vary. Refunds must be claimed through Revenue Scotland, and accurate legal advice is essential to ensure eligibility.

Practical Considerations for Buyers Moving to Ayrshire

Timing your sale and purchase carefully can make a significant difference. Selling your English home before completing on a Scottish purchase often avoids additional property taxes altogether. If you buy first, you’ll usually need to pay the extra tax upfront and apply for relief later, which can impact cash flow.

Council Tax is another important consideration. Many Scottish councils, including those covering Ayrshire, apply higher rates to second homes. If your new property is classed as a second residence, this can significantly increase ongoing costs until your previous home is sold.

When selling your English property, Capital Gains Tax is usually not payable if it has been your main residence throughout ownership. However, CGT may apply if the property has been rented out or used as a second home at any stage, so professional advice is recommended.
